The San Joaquin County District Attorney's Office, under the leadership of District Attorney Ron Freitas, has secured a significant plea deal under Proposition 36 (Prop 36). This deal emphasizes our commitment to robust prosecution while acknowledging the broader implications of criminal behavior in our community.
In a recent case, James Lee Cooper, 41, of Stockton, an individual with a history of violent behavior toward Loss Prevention Officers (LPOs), was charged after swinging a milk jug at a store employee during an attempted theft. This incident, classified beyond mere shoplifting due to multiple prior thefts, underscores the severity of the crime. The plea was made to California Penal Code ยง 666.1, which punishes a person previously convicted twice of theft-related offenses.
District Attorney Ron Freitas stated, "This isn't just about theft; it's about protecting our community's peace and safety. When someone repeatedly steals without regard for the safety of the LPOs, it transcends petty theft and becomes a more serious offense. With Prop 36, we've adapted our approach to ensure those threatening our community face real consequences."
This case marks the first state prison sentence under Prop 36 in San Joaquin County, highlighting our proactive stance in adapting to new legal frameworks to address crime more effectively. Our collaboration with local businesses, who have expressed satisfaction with this outcome, further demonstrates our commitment to community safety through the Business Watch program.
Due to a prior criminal record, the defendant has been sentenced to 3 years in state prison as part of the agreement. This punishment reflects the seriousness with which the court views crimes involving violence, especially when committed by repeat offenders.
